In all my years with PACE we have never had a situation where something was so important that I need to present it this way.
As those of you that follow us know Chuck Evans has filed a Declaratory Judgment Case challenging Ohio's custody law in State court. That case is currently frozen by the actions of Judge Sheward of Franklin County, a judge that does not have subject matter jurisdiction over the case, when he declared Chuck a vexatious litigant in a totally unrelated case.
Judge Sheward's actions have taken away Chuck's access to the courts totally and he can not proceed in ANY court action in any court within the State Of Ohio without being granted Leave To Proceed by Sheward. Sheward has stated that Chuck must have his permission to file anything, even thru his Counsel. To date Sheward has denied Counsel and Chuck Leave to Proceed three times.
Is this the way that they make us go away so that the State can take control of your children, by playing backdoor politics with a man's life just to shut him up? Personally I refuse to go quietly into the night as my constitutional rights are taken away.
Without Sheward's permission to proceed, Chuck is done for ever. He will lose his ability to fight anything in court and to defend himself in any action taken against him. He will lose his son completely and any assets that he should have from his marriage. He will not be able to appeal any decision, in any court and will not be able to challenge the laws of this State.
A complaint for the removal of Sheward has been filed with the State of Ohio legislators. We need your help to make this happen as quickly as possible. While a copy of this complaint has been presented to every Representative and Senator in the State, additional pressure is needed from more that Chuck, Mike Galluzzo and myself.
That is where you come in. A sample letter to your legislators is located here as well as all evidence and the complaint for removal. We need you to call or write your State Representatives and Senators today and politely ask them to move quickly on this removal. No judge on any bench anywhere should ever have the ability to take a man's guaranteed constitutional rights to the Courts and to his child.
The choice in this is yours to make, write or call your legislator or turn your back on the last chance to change the custody laws of Ohio and maybe the nation thru the courts. We also need to continue to raise funds for this effort. I want to thank those that did contribute but that money is gone. We have paid several different filing fees and paid for the cost of printing the complaint for removal of Sheward. Much of this effort has for years been paid for by Chuck Evans, Mike Galluzzo and myself out of our own pockets. Those pockets are now bare. None of us are paid for our time. We have done this for the love of our children. I am still in the fight and will remain so despite the fact that y son is now 19 and I am out of the system. I need to assure that his rights are protected in the future.
Now is the time for all of us to step to the plate and dig deep to help change the laws that we all know are wrong.
